General Terms and Conditions
Definitions:
"RadarMusicVideos", “Radar”, "we", "us", means the company trading through www.radarmusicvideos.com and registered as The Radar Festival Limited company registration 6121379, company registered address 86 Liddell Gardens, London NW10 3QE. The “Radar Site” means the web based music video director and promotion service accessed at www.radarmusicvideos.com “Client” or “Clients” means the record label, artist, brand or other third party commissioning music video production, promotion or other services offered and delivered by RadarMusicVideos. On the website, “Commissioner account”, “Commissioner Pro account” and “Commissioner Pro plus Promotion account” are the types of Client account, they describe account types which allow account holders to variously post music video briefs, see treatments from Directors, link videos and to access promotional benefits. “Director account” describes the account type which allows account holders to access and submit treatments for music video briefs and to link videos to Radar. “Director” or "Directors" means a member who has or has held a Director account. . “User”, "Users" or “You” means anyone interacting with the RadarMusicVideos website.
“ Content” means any materials supplied by a Director or Client to Radar, which may or may not be featured on the Radar Site. “Video” or “Videos” means a video file linked to and available for viewing via the Radar Site.
“Brief” means the invitation to submit treatments, posted on the site by a Client. “Treatment” means the idea submitted by a director to a Client, using any combination of words, images or video, which describes the video the Director would make if commissioned.
1 Community Guidelines
All users agree to treat other users with respect and refrain from ‘flaming’, spamming or otherwise anti-social behaviour. RadarMusicVideos reserve the right to immediately ban users who do not abide by the guidelines.
2 Copyright & Intellectual Property Rights
All content and materials on the RadarMusicVideos website are protected under copyright and intellectual property rights laws of England and Wales and under similar international legislation
. RadarMusicVideos owns and retains all intellectual property and proprietary rights to all materials in the Radar Site, excluding content published or linked by its members. No part of the Radar Site belonging to Radar may be copied, reproduced, distributed or published without RadarMusicVideos’ written permission.
Users confirm that all media and content published or linked to on the Radar Site is

-copyright approved to link to the site and/or
-copyright owned by you
It is your responsibility to understand and identify what is copyright in your content and how copyright approval can be secured.
2 Defamation
You confirm that by publishing or linking content on the Radar site you accept responsibility for that content and that the content is neither offensive nor defamatory.
3 Promotion
You give RadarMusicVideos the right to promote any video you link to the Radar Site, for the purpose of promoting the video and/or RadarMusicVideos.
4 Membership Cancellation
You may delete your account at any time by emailing a request to info@RadarMusicVideos.com. Any subscription fees already paid will not be refunded. You are free to cancel your subscription at any time, for example from within your own Paypal account.
5 Membership Termination
We may terminate your membership if you breach these Terms and Conditions or deliberately seek to circumvent payment or security measures deployed on the Radar Site, or if we deem it appropriate. If your membership is terminated by us your subscription fees may be forfeit. Termination based on misuse of the site or breach of these Terms and Conditions will be at Radar’s sole discretion.
6 Restricted Content
RadarMusicVideos.com is a site aimed at users over the age of 18 years of age. RadarMusicVideos is not liable for the content of profile pages, linked videos and site comments. View the site at your own risk, and ensure that minors are accompanied by an adult when viewing.
7 Pricing and Price Changes
RadarMusicVideos reserves the right to change or introduce charges at any time without prior notice.
8 Profile Information
By uploading your profile, name, images, and/or contact details, you agree that you are deciding at your own risk to make this information available on the internet. RadarMusicVideos accepts no responsibility or liability arising from use or misuse of your personal information that can be freely viewed by Internet users.
9 Security
RadarMusicVideos has a password protection scheme to protect your profile content. It is your responsibility to protect your password, and if you are concerned about the security of your password, you should change it. You agree to indemnify RadarMusicVideos against any claims or liability relating to a security breach of RadarMusicVideos via your password.
10 Provision and Loss of Service
RadarMusicVideos reserves the right to disable the site without prior notice if needed to perform maintenance on the Radar Site, or any technical service supporting or related to it. We cannot be held responsible for damage to content following a technical failure, please take steps to back up your content elsewhere.
11 Our Liability
You agree that we will not be liable for any loss or damage you incur (including but not limited to loss of profit, loss of business, loss of revenue, or any other incidental or consequential loss or damage) whether indirectly or directly caused by RadarMusicVideos or by the use of the site.
12 Jurisdiction
Radar Music Videos is owned and operated by The Radar Festival Ltd, based in England. Any dispute arising through the use of this site or relating to these Terms and Conditions will be presented before a court in England or Wales and be subject to the law of England and Wales.
Terms and Conditions relating to Video Promotion
1 Video Promotion Terms and Conditions apply to:
- Featured or showcased videos selected by RadarMusicVideos,
- Videos commissioned through RadarMusicVideos.
2 Directors who supply Videos to Radar must obtain the consent of all rights owners in the Videos, with the full knowledge and consent of copyright owners to these terms and conditions.
3 Clients and Directors agree videos they have linked to the site may be featured without other prior agreement, one week after the release date of the track, on RadarMusicVideos.com, the RadarMusicVideos Facebook page, and on any other blogs and websites that we in our sole discretion may select, Clients and Directors agree that we may enter videos into real world/offline film and music festivals.
4 The Client or Director supplying Videos to RadarMusicVideos is responsible for confirming in writing any restrictions regarding usage of the Videos, including requirements which apply to metadata .
5 Users may request that their Video be withdrawn from RadarMusicVideos’s channels on third party sites within 30 days of the request being received by Radar. Upon receipt by Radar of specific written notice of withdrawal from the Client or Director supplying the Video to Radar, Radar will request the third party site to withdraw the specified Video. It is the responsibility of the User, not Radar, to ensure that a request to take down Video has been implemented by a third party. Radar reserves the right to withdraw immediately videos which we believe could give rise to any legal claims, create offence, or otherwise harm RadarMusicVideos’ good standing. Videos are uploaded to third party sites subject to the terms and conditions of those third party sites. Users supplying Videos to RadarMusicVideos acknowledge the possibility that third party terms of operation may not impose sufficient obligations to ban customers from reproduction of Videos and the possibility that Videos may be streamed with insufficient security encoding.
6 Directors expressly acknowledge that it is the responsibility of third party sites where Videos are shared to obtain the necessary mechanical licenses, and to make royalty payments and other payments required by law. Radar may, on occasion, advise you as to whether a third party site is not taking responsibility for this, in which case responsibility to obtain licenses and make any required payments passes to you.
7 The Client or Director supplying the Video warrants they have obtained all necessary consents for usage of the Video from all copyright owners in the Master, including all rights relating to the music of the Master. They warrant that the Masters do not infringe the rights of any third parties and agree to hold harmless and indemnify RadarMusicVideos against any costs, claims or damages from any third parties.
8 All videos linked to the site are eligible for selection for the Radar Showcase. Selection is made by RadarMusicVideo’s editors and cannot be requested or bought. When a video is selected, the director or client who linked the video is contacted by RadarMusicVideos and given the opportunity to withdraw the video from selection.
